No Long-Term Contracts
Crackerjack Strategies does not require long-term contracts for most services.
Clients may continue services on a flexible monthly basis and may cancel services in accordance with the cancellation policy outlined below.
Billing Terms
All services are billed automatically on a recurring monthly basis unless otherwise stated in writing.
Payment Terms
- Monthly services are billed in advance
- Client authorizes recurring billing for active services
- Payment methods are securely stored through third-party billing providers
- Failure to maintain a valid payment method may result in suspension of services
Failed or Late Payments
Accounts with failed or declined payments may experience service interruption until payment is successfully processed.
Crackerjack Strategies reserves the right to suspend services for overdue accounts.
No Refund Policy
Due to the time, labor, and intellectual resources invested in digital marketing and website services, all payments made to Crackerjack Strategies are non-refundable.
This includes:
- Monthly service fees
- Setup fees
- Website design services
- SEO services
- Marketing services
- Consulting services
- Hosting services
- Optimization services
Digital marketing performance depends on factors outside of our control including search engine algorithms, competition, market conditions, and third-party platform changes.
Specific rankings or business outcomes cannot be guaranteed.
Cancellation & Termination Policy
Client Cancellation
Clients may cancel services at any time with a minimum 30 day written notice submitted via email.
Cancellation terms:
- Services remain active during the 30 day notice period
- Final billing will occur during the notice period
- Services may be discontinued after the termination date
- Cancellation requests must be submitted in writing
Company Right to Terminate Services
Crackerjack Strategies reserves the right to terminate services at any time.
Reasons may include:
- Non-payment
- Abusive or inappropriate communication
- Violation of platform policies
- Illegal or unethical business practices
- Failure to provide necessary information
- Requests outside the agreed scope of services
- Repeated failure to communicate
Pricing, Fee Adjustments, and Third-Party Services
Crackerjack Strategies strives to provide high-quality digital marketing services at fair and competitive rates. Because our services are provided on a month-to-month basis without long-term contracts, we reserve the right to modify our pricing for products and services as our business, operating costs, and service offerings evolve.
Existing clients will receive at least 30 days’ advance written notice before any increase to recurring service fees takes effect.
Price adjustments may occur for reasons including, but not limited to:
- Changes in operating expenses or business costs
- Expanded or enhanced service offerings
- Changes in market conditions
- Increases in software licensing, hosting, or subscription fees
- Changes in third-party vendor pricing
- Inflation or other economic factors
If you do not agree with a pricing adjustment, you may cancel your recurring services by providing written notice before the effective date of the new pricing, in accordance with the cancellation terms outlined in these Terms of Service.
Unless otherwise stated in writing, published pricing is subject to change without notice for new customers, new projects, and new service purchases.
Final Account Balance & Offboarding Deliverables
All outstanding balances must be paid in full before Crackerjack Strategies is required to provide final account transfers, website exports, data exports, migration files, administrative access transfers, or other offboarding deliverables.
If an account has an outstanding balance at the time services terminate, Crackerjack Strategies may withhold these deliverables until the account is paid in full. This does not extend or reinstate terminated services, hosting, subscriptions, licenses, or other services.
Once the outstanding balance has been satisfied, Crackerjack Strategies will provide applicable offboarding materials in accordance with these Terms of Service.
Crackerjack Strategies is not required to provide proprietary software, licensed plugins, third-party subscriptions, internal tools, proprietary configurations, internal reports or working files unless specifically included in the applicable service agreement.
Third-Party Services
Many of the services provided by Crackerjack Strategies rely on third-party software, hosting providers, marketing platforms, domain registrars, email providers, and other technology vendors. If a third-party provider increases its pricing, modifies its billing structure, discontinues a service, or otherwise impacts the cost of providing your services, Crackerjack Strategies reserves the right to adjust the applicable fees accordingly. Whenever practical, clients will receive at least 30 days’ advance written notice before such adjustments take effect.
Taxes and Government Fees
Unless otherwise stated, all pricing is exclusive of applicable sales tax, use tax, or other government-imposed taxes and fees. Any required taxes or governmental charges will be added to invoices where applicable and are the responsibility of the client.
Website Ownership
Clients retain ownership of the content created specifically for their website once payment has been made in full.
Website content may include:
- Written page content
- Blog articles
- Images provided by client
- Non-licensed graphics
- Contact form submissions
- Business information
- Logo files provided by client
Crackerjack Strategies retains ownership of proprietary systems, workflows, templates, and configurations used to deliver services.
Website Access & Administrative Control
While clients retain ownership of their website content, Crackerjack Strategies maintains administrative control of the WordPress environment for websites under active management.
Backend Access Policy
To maintain website stability, security, and performance, administrative backend access to WordPress installations managed by Crackerjack Strategies is not provided during the active service period.
This policy helps:
- Protect website functionality
- Maintain SEO configurations
- Prevent plugin conflicts
- Maintain site speed optimization
- Protect licensed software
- Maintain security configurations
- Prevent accidental damage to website structure
Clients may request content edits or updates at any time as part of their ongoing service plan.
Website Data Export & Content Transfer
Upon termination of website services, clients may request a copy of their website content in WordPress XML Export format (WXR file).
When Export Files Are Provided
Export files are provided only after a formal Termination of Service has been submitted.
Export files are not provided on a recurring basis during active service periods.
Because websites are continuously updated and optimized, export files represent a snapshot of the website at the time of termination.
Providing ongoing export files during active service would create version inconsistencies and administrative inefficiencies.
Requests for export files must be made within 30 days of termination.
WordPress XML Export May Include
The WordPress XML Export file may contain:
- Pages
- Blog posts
- Image references
- Media file paths
- Categories
- Tags
- Comments
- Custom fields
- Navigation menus
- Basic content structure
Export Limitations
Export files do not include:
- WordPress theme files
- Plugin files
- Premium plugin licenses
- Custom design frameworks
- Proprietary configurations
- Hosting environment settings
- Performance optimization settings
- Licensed software configurations
Clients may import the XML file into another WordPress installation using the WordPress Import tool.
Licensed Plugins & Software
Some websites utilize premium or licensed plugins purchased or maintained by Crackerjack Strategies.
Unless otherwise agreed in writing:
Licensed plugins remain the property of Crackerjack Strategies.
These licenses are not transferable upon termination of service.
Clients may purchase their own licenses if they wish to continue using the same premium tools independently.
Examples may include:
- performance optimization plugins
- SEO tools
- security software
- design framework licenses
- premium form builders
- caching software
Google Analytics & Search Console Access
Websites managed by Crackerjack Strategies may be connected to Google Analytics and Google Search Console for performance tracking and optimization.
Ownership and access permissions may vary depending on the setup.
In most cases:
Crackerjack Strategies retains administrative control of analytics configurations during active service in order to:
- maintain accurate tracking
- prevent configuration errors
- preserve historical data integrity
- ensure consistent reporting
Upon termination of service, reasonable efforts will be made to transfer ownership or provide appropriate access when possible.
Clients are responsible for maintaining access to their own Google accounts.
Crackerjack Strategies is not responsible for lost data due to account access changes made by third parties.
Privacy and Data Protection
Crackerjack Strategies respects client privacy and does not sell or share personal information with third parties for marketing purposes.
Information collected may include:
- contact details
- business information
- login credentials provided for service implementation
- website analytics data
Information is used solely for the purpose of delivering services.

Acceptable Use Policy
Clients agree not to use services provided by Crackerjack Strategies for unlawful or deceptive purposes.

Timelines may vary depending on complexity, scope changes, and client response time.
Performance Disclaimer
We follow industry best practices to improve visibility and performance but cannot guarantee:

- sales performance
SEO and digital marketing are long-term strategies influenced by competition and third-party algorithms.
Limitation of Liability
Crackerjack Strategies shall not be liable for indirect or incidental damages including:
- loss of revenue
- website downtime
- data loss from hosting providers
- ranking fluctuations
- third-party service interruptions
Total liability shall not exceed the amount paid for services within the previous billing period.
SMS Messaging Terms
By providing your mobile phone number to Crackerjack Strategies, you consent to receive SMS text messages from us regarding your account, services, and marketing promotions.

Service Suspension & Reinstatement
Services suspended due to failed payment, non-payment, expiration of a valid payment method, violation of these Terms of Service, or other account-related issues are not automatically reinstated upon payment of an outstanding balance.
Reinstatement of suspended or terminated services is subject to approval by Crackerjack Strategies and may require payment of all outstanding balances, establishment of a valid payment method, and payment of a reinstatement or reactivation fee.
The amount of any reinstatement fee may vary depending on the services involved and the work required to restore the account, including website restoration, software configuration, third-party integrations, listings synchronization, analytics configuration, or other technical services.
Payment of an outstanding balance does not guarantee reinstatement of services. Crackerjack Strategies reserves the right to decline reinstatement and require a new service agreement, setup fee, or current service pricing before services resume.
Any reinstated services may be subject to Crackerjack Strategies’ then-current pricing and service terms rather than previously discounted, promotional, trade, or legacy pricing.
Payment of outstanding balances after termination does not reinstate previously terminated services or extend the client’s prior service agreement.
California Legal Compliance
These Terms shall be governed by the laws of the State of California.
Any disputes shall be resolved in the appropriate jurisdiction within California.
Both parties agree to attempt good-faith resolution prior to legal action.
